Wills
Medical science is allowing us to live longer now. However, old age compels us to deal with issues like deteriorating health, illness, and disability. Everyone should possess the following incapacity documentation before the incapacitating event occurs to allow for family or friends to help with their financial and medical care.

  • Statutory Durable Power of Attorney - you appoint an agent to act on your behalf in the event of incapacity. The document allows your agent to handle your financial and business needs.
  • Medical Power of Attorney - you appoint an agent to act on your behalf regarding medical decision when you are incapacitated.
  • Designation of Guardian before need arises - a guardianship is a long and expensive court process. This document allows you to appoint a person of your choice as the guardian of your person and/or estate in the event that a guardianship is necessary. The document also allows you to disqualify a person from serving as your guardian.
  • The Living Will - provides for the termination of life for a person with a Aterminal condition or an Airreversible condition. A Aterminal condition means that according to reasonable medical judgment, death is imminent within six (6) months. An Airreversible condition means a condition that may be treated but is never cured or eliminated, and that is fatal without life sustaining treatment.
  • Last Will and Testament - you should have a Will. It is your property and you should be the person to decide who gets it after you don't have any more use for it. Dying with a will allows an expeditious and reasonably inexpensive probate process that maintains harmony among your loved ones. On the other hand, dying without a will is time consuming, expensive, and generally causes conflict among your loved ones.

 

Probate
At this time of loss, you should have a knowledgeable and skillful lawyer to guide you through the probate process, which does not have to be a stressful or complicated ordeal. I am always sensitive to your need for an expedient and inexpensive resolution to all issues in wrapping up the affairs of the decedent's estate. Depending on the facts of each case, you will be advised as to the proper method of probate and sometimes, probate may even be avoided.
